CapVault is a mobile application that provides bottle cap recognition and collection management services. The Service includes:

4. User Accounts

• Use the Service or content for any commercial purpose

CapVault and related logos are trademarks or registered trademarks of CapVault. You may not use these marks without our prior written permission.

7. Camera and Device Permissions

CapVault requires access to your device's camera to provide bottle cap recognition functionality. By granting camera permissions, you authorize the app to:

• Capture images for real-time recognition
• Process images locally on your device
• Upload images to our servers for advanced processing (as described in our Privacy Policy)

You may revoke these permissions at any time through your device settings, though this will limit the app's functionality.

10.2 Recognition Accuracy

While we strive to provide accurate bottle cap recognition, we do not guarantee that the recognition results will always be correct or complete. The recognition technology may produce errors or fail to identify certain caps.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPVAULT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of your data
• Any interruption or cessation of the Service
• Any bugs, viruses, or harmful code transmitted through the Service
• Any errors or omissions in content or recognition results

10.4 Maximum Liability

In no event shall our total liability to you for all claims related to the Service exceed the amount you paid us, if any, in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

You agree to indemnify, defend, and hold harmless CapVault, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

12. Modifications to Terms

Your continued use of CapVault after any modifications indicates your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

13. Termination

These Terms remain in effect until terminated by either you or us. You may terminate your agreement with us at any time by deleting your account and ceasing to use the Service.

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws or regulations
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity

Upon termination, your right to use the Service will immediately cease, and we may delete your account and all associated data.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CapVault is registered, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiations between the parties.

14.3 Arbitration

If negotiations fail, any dispute shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association in the jurisdiction where CapVault is registered. The arbitration shall be conducted in English, and the decision of the arbitrator shall be final and binding.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CapVault regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or internet service failures.
