By downloading, installing, or using the CapVault mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our app.

All content, features, and functionality of CapVault, including but not limited to text, graphics, logos, icons, images, software, and the recognition algorithm, are owned by CapVault or its licensors and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. This license does not include any right to:

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
While we strive to provide accurate bottle cap recognition, we do not guarantee that the recognition results will always be correct or complete. The recognition technology may produce errors or fail to identify certain caps.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPVAULT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiations between the parties.
If negotiations fail, any dispute shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association in the jurisdiction where CapVault is registered. The arbitration shall be conducted in English, and the decision of the arbitrator shall be final and binding.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CapVault regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term.
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or internet service failures.
